The Kentucky State Police Pikeville Post 09 is continuing their investigation into the death of a Magoffin Co. man, whose body was found over the weekend.
According to a news release from the KSP, at approximately 8 PM on Sunday, May 27, Post 09 received information of a person being found unresponsive in a creek in the 1000 block of Johnson Fork Road in the Gunlock Community of Magoffin Co.
Troopers, responded to the scene along with Magoffin Co Sheriff Office, and Magoffin Co Rescue.
Upon arrival Joseph Smithers (age 33 from the Gunlock area) was discovered deceased in the creek.
Troopers say Smithers was shot.
The Magoffin Co Coroner pronounced Mr. Smithers deceased at the scene.
An autopsy is pending for the cause of death.
The case remains open and is under the investigation of Detective Newsome.
